IMPORTANT: PLEASE READ THE TERMS AND CONDITIONS OF THIS LICENSE AGREEMENT CAREFULLY BEFORE USING THE SOFTWARE. PKMZ Hosting SOFTWARE DESIGN AND/OR ITS SUBSIDIARIES (“PKMZ Hosting”) IS WILLING TO LICENSE THE SOFTWARE TO YOU AS THE INDIVIDUAL, THE COMPANY, OR THE LEGAL ENTITY THAT WILL BE UTILIZING THE SOFTWARE (REFERENCED BELOW AS “YOU” OR “YOUR”) ONLY ON THE CONDITION THAT YOU ACCEPT ALL OF THE TERMS OF THIS LICENSE AGREEMENT. THIS IS A LEGAL AND ENFORCEABLE CONTRACT BETWEEN YOU AND PKMZ Hosting. BY OPENING THIS PACKAGE, BREAKING THE SEAL, CLICKING THE “ACCEPT”, “YES” OR “NEXT” BUTTON OR OTHERWISE INDICATING ASSENT ELECTRONICALLY, OR LOADING THE SOFTWARE, YOU AGREE TO THE TERMS AND CONDITIONS OF THIS AGREEMENT. IF YOU DO NOT AGREE TO THESE TERMS AND CONDITIONS, CLICK THE “I DO NOT ACCEPT”, “NO” OR “CANCEL” BUTTON OR OTHERWISE INDICATE REFUSAL, MAKE NO FURTHER USE OF THE SOFTWARE.
1. License:
The software and documentation that accompanies this license (collectively the “Software”) is the property of PKMZ Hosting, or its licensors, and is protected by copyright law. While PKMZ Hosting continues to own the Software, You will have certain rights to use the Software after Your acceptance of this license. This license governs any releases, revisions, or enhancements to the Software that PKMZ Hosting may furnish to You. Except as may be modified by a PKMZ Hosting license certificate, license coupon, or license key (each a “License Module”) that accompanies, precedes, or follows this license, Your rights and obligations with respect to the use of this Software are as follows.

You may:
A. Use the Software, if you are financially able to make a donation to PKMZ Hosting for the Software. You should do so. If the Software is used on a network, and You are financially able to make a donation to PKMZ Hosting for the Software You should also do so for every client on the network.

You may not:
A. sublicense, rent, or lease any portion of the Software; reverse engineer, decompile, disassemble, modify, make any attempt to discover the source code of the Software, or create derivative works from the Software;
B. use the Software as part of a facility management, timesharing, service provider, government agency or service bureau arrangement without explicit prior consent from PKMZ Hosting;
C. use a previous version or copy of the Software after You have received a disk replacement set or an upgraded version. Upon upgrading the Software, all copies of the prior version must be destroyed;
D. use the Software, if You are financially able to make a donation to PKMZ Hosting for the Software and have not made a donation to PKMZ Hosting.
E. use the Software in any manner not authorized by this license; nor
F. use the Software in any manner that contradicts any additional restrictions set forth below.
2) Copyright.
The Software contains confidential information owned by PKMZ Hosting Software Design and all copyright trademarks and other intellectual property rights in the Software are the exclusive property of PKMZ Hosting Software Design.

3) Disclaimer of Warranty.
THERE IS NO WARRANTY FOR THE SOFTWARE. ALL EXPRESS OR IMPLIED REPRESENTATIONS AND WARRANTIES, INCLUDING ANY IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT, ARE HEREBY EXCLUDED TO FULLEST EXTENT PERMITTED BY LAW. PKMZ Hosting DOES NOT WARRANT THAT THE OPERATION OF THE SOFTWARE WILL BE UNINTERRUPTED OR ERROR-FREE.
4) Limitation of Liability.
IN NO EVENT WILL PKMZ Hosting BE LIABLE FOR ANY LOST REVENUE, PROFIT, OR DATA, OR FOR SPECIAL, INDIRECT, CONSEQUENTIAL, INCIDENTAL OR PUNITIVE DAMAGES HOWEVER CAUSED.
5) Term.
The term of the license granted herein shall be perpetual unless terminated by written notice by You or terminated by either party for material breach. Immediately upon termination of this license for any reason You shall cease using the Software in any form.
6) Distribution
PKMZ Hosting grants permission for the use of the Software in magazines, cover mounts associated with the magazine and subscription CD’s or DVD’s associated with the magazine. PKMZ Hosting grants permission for the Software to be installed on new or used computers by retailers. You may not profit from the individual sale of the Software. In issuing the Software, you must disclose to the recipient that the Software is free of charge or freeware. PKMZ Hosting can revoke distribution permission at any time as PKMZ Hosting deems necessary.
